Terms of Service

These Terms of Service ("Terms") govern any order placed with Jinglebaby ("Jinglebaby," "we," "us") through this website. By submitting the intake form or otherwise placing an order, you ("Client," "you") agree to these Terms.
1. The Service
Jinglebaby writes and produces an original custom jingle (the "Master") based on the information Client provides, in the package configuration Client selects at checkout.
2. Ownership
Jinglebaby owns all right, title, and interest in and to the musical composition and sound recording that make up the Master, including all copyrights, under applicable copyright law. Nothing in these Terms transfers or assigns that ownership to Client. Client's payment is for the license described in Section 3, not a purchase of the copyright.
3. License Grant
Upon full payment, Jinglebaby grants Client a non-exclusive, worldwide, perpetual license to use the Master in advertising, marketing, on-hold messaging, broadcast, digital, and social media in connection with the business named at the time of order. This license does not include the right to:
- Resell, sublicense, or redistribute the Master as a standalone audio product;
- Claim authorship of the composition or recording; or
- Use the Master in connection with a different business than the one named in the order, without Jinglebaby's written consent.
4. Streaming Release and Royalties
Jinglebaby releases the Master to Spotify and other digital service providers under the Jinglebaby artist page, so it can be selected in platforms' built-in music pickers for social posts. Jinglebaby retains all streaming, mechanical, performance, and other royalties generated by that release. Client is not entitled to any share of streaming or royalty revenue.
5. Client-Provided Content
Any business name, phone number, tagline, or other material Client submits for inclusion in the lyrics remains Client's property. Client represents that it has the right to use that material and to have it included in the Master.
6. Payment
Prices are as listed on the site at the time of order unless otherwise agreed in writing. Payment is collected through Stripe at the time of order. Full payment is due before production begins.
7. Revisions and Delivery
Jinglebaby will share drafts before finalizing the Master and incorporate reasonable creative revisions consistent with the original brief. Requests that go substantially beyond the original brief may incur an additional fee. Final masters are delivered electronically as WAV and MP3 files.
8. Termination
Either party may cancel an order before delivery of the final Master. Fees for work already completed are non-refundable.
9. Disclaimer and Limitation of Liability
The Master is provided "as is." Jinglebaby is not liable for indirect, incidental, or consequential damages arising from Client's use of the Master, including any claims arising from Client-provided content.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
11. Changes to These Terms
Jinglebaby may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continuing to use the site or placing an order after changes take effect constitutes acceptance of the revised Terms.
